Statement on Data Protection

The Physikalisch-Technische Bundesanstalt (PTB) Braunschweig and Berlin, represented by its president Prof. Dr. Cornelia Denz, Bundesallee 100, 38116 Braunschweig, Germany, Phone: +49 (0) 531 592-0, E-Mail: info(at)ptb.de, is responsible for the processing of your personal data in connection with your application.

PTB attaches particular importance to the protection of your personal data and provides technical and organizational measures in accordance with Article 5 (1) f) and Article 32 of the European General Data Protection Regulation (GDPR), to ensure that your data is protected against unauthorized or unlawful processing, accidental loss, destruction or damage.

Hence, your data will only be transmitted via the Internet using SSL-encryption.

Below, PTB would like to inform you about the details of the processing of your personal data in the context of the application process and the rights granted to you.

 

I. Data Processing

1. General

In order to be able to make personnel decisions in the application process, PTB requires applicants to provide information on their person, career, past/present training and/or professional stations.

Certificates, CVs, cover letters and other documents submitted for such recruitment purposes contain personal data within the meaning of Article 4 No.1 GDPR and are processed by PTB on the basis of Article 88 (1) GDPR in conjunction with § 26 Federal Data Protection Act (BDSG) for recruitment purposes to facilitate a decision on the establishment of an employment relationship and only to the necessary extent.

After receiving your application, your personal data will be processed by the responsible personnel administrator. You will receive the administrator’s contact details when PTB confirms reception of your application.

Within PTB, your data will be forwarded to the person responsible for HR / personnel of the department involved, interest representatives and - when applying for a training place - to the responsible trainers.

Your data will be processed exclusively by PTB and not be disclosed to third parties.

 

2. Further processing based on consent

You may give PTB permission to forward your application to other Organizational Units within PTB by affirming to the relevant question in the online application form or when directly asked in writing.

Such further processing of your personal data will be based on Article 6 (1) a) GDPR only for the stated purpose and within PTB. Your data will not be shared with any third party.

You have the right to withdraw your consent at any time with effect for the future. Please refer to Section II for further information on withdrawal of consent.

Not giving (or withdrawing) your consent, will not affect the recruitment process as far as the position you have applied for is concerned. You are, of course, free to apply for any job offered by PTB. Your consent in this paragraph’s sense is neither prerequisite, nor mandatory for this.

 

3. Online Application Form

When using the PTB online application form to submit your application documents and data, you will be asked to create a user account. The personal data processed during the creation of the user account, as well as the data entered into the form’s various input fields will be processed on the same basis as data processed within the scope of Section I Paragraph 1, namely Article 88 (1) GDPR in conjunction with § 26 (1) BDSG and only to the extent necessary for recruitment purposes and deleted following the same guidelines.

 

4. Deleting your data

If the recruitment process leads to your employment, the documents provided with your application will (to the extent necessary) become part of your personnel file. Any other data not needed will be deleted six (6) months after completion of the recruitment process. PTB will separately inform you about the legal basis concerning your personnel file in connecting with the hiring.

If your participation in the recruitment process remains unsuccessful, your data will also be deleted six (6) months after completion of the recruitment process.

If you have consented to further processing of your data according to Section I Paragraph 2, your data will be deleted twelve (12) months after completion of the recruitment process. If you withdraw your consent before completion or before six (6) months after the completion of the recruitment process have elapsed, your data will be deleted six (6) months after completion of the recruitment process.

If you withdraw your consent later than six (6) months after completion of the recruitment process, your data will be deleted immediately.

 

You may, of course, withdraw your application as a whole at any time. Just send an e-mail to bms(at)ptb.de. Your data will be deleted immediately. Of course, you are free to apply again.

 

II. Your Rights as a Data Subject

Data subjects may exercise certain statutory rights wherever their personal data are processed. These are in particular:

 

Right of Access: According to Article 15 GDPR, you have the right to obtain, free of charge, confirmation as to whether PTB processes personal data concerning you, access to this data by means of a copy of such personal data undergoing processing and in particular information concerning:

  • the purposes of processing,
  • the categories of personal data concerned,
  • the recipients or categories of recipient to whom the personal data have been or will be disclosed,
  • the envisaged period for which the personal data will be stored, or the criteria used to determine that period,
  • where the personal data are not collected from you, any available information as to their source.

When responding to a request for information, PTB will also provide you with any other information stipulated by Article 15(1) and (3) not expressly mentioned in this statement on data protection.

 

Right to Rectification: According to Article 16 GDPR, you have the right to obtain from PTB without undue delay the rectification of personal data concerning you or, if applicable, the right to have incomplete personal data completed.

 

Right to Erasure: According to Article 17 GDPR, you have the right to obtain erasure of your personal data processed by PTB if the conditions of Article 17(1) are met. This right will - according to Article 17(3) - not apply to processing necessary e.g. for exercising right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims.

 

Right to Restriction of Processing: According to Article 18 GDPR, you have the right to obtain from PTB restriction of processing:

  • for a period enabling PTB to verify the accuracy of your personal data contested by you, and/or
  • in case the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead, and/or
  • when you require the personal data for the establishment, exercise or defence of legal claims, but PTB no longer needs them for the purposes of the processing and hence would need to delete them, and/or
  • when you objected to processing pursuant to Article 21(1) pending the verification whether the legitimate grounds of PTB override yours.

Personal data whose processing has been restricted will, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

PTB will inform you before any restriction of processing in the above sense is lifted.

 

Right to Data Portability: According to Article 20 GDPR, you have the right to receive the personal data concerning you, which you have provided to PTB, in a structured, commonly used and machine-readable format when and insofar processing of this data is based on your consent or on a contract and when this processing is carried out by automated means.

 

Right to Withdrawal of Consent: According to Article 7 (3) GDPR, you have the right to withdraw your consent to processing your personal data when and insofar processing is based thereon with effect for the future. Withdrawal will not affect the lawfulness of processing based on consent before its withdrawal. You may direct your withdrawal towards the e-mail-address mentioned in this website’s imprint, bms(at)ptb.de, or use any other means of communication.

 

Right to Lodge a Complaint with a Supervisory Authority: According to Article 77 GDPR, you - without prejudice to any other remedy - have the right to lodge a complaint with a supervisory authority if you consider that PTB’s processing of your personal data infringes data protection law. This complaint may be lodged with a single supervisory authority within the territorial scope of the GDPR.
